Registration of Foreign Trademark in Nepal: New Process 2025
1. Background:
A trade-mark is a word, symbol, or image, or a combination of words, symbols, and words, used by a firm, company, or individual to distinguish the goods or services they produce or provide from those of others.
Foreign entity can register trademarks in Nepal through the Department of Industry (“DOI”). Two primary methods are available:
a) Registration of the Trademark, if the Trademark has been applied or registered in any country outside Nepal, and
b) Applying the Trademark with claiming priority under the Paris Convention if the trademark is already filed in another Paris convention country.

3. Concerned Authority to obtain Foreign Trademark Registration
The Department of Industry is responsible for trademark registration in Nepal.
4. Register-ability of the Trademark:
The following matters shall not qualify for Trademark Registration. They are;
- If the proposed Trademark hurt the goodwill and reputation of any individual or institution,
- If it effects on the public conduct or morality or national interest,
- If it undermines the reputation of the TM of any other person
- If it has already been registered in the name of the another person and entity.
5. Process of obtaining certificate of foreign Trademark Registration in Nepal
The process for obtaining certificate of foreign trademark registration in Nepal are:
- Conducting prior search report
- Filing an application
- Examination of the application by DOI
- Publication of the applied trademark in the IP Bulletin.

6. Required Documents
Documents required for the registration of the Trademark are as follows:
- Application
- Notarized Home/Foreign Trademark registration Certificate;
- Notarized power of attorney;
- 4 copies of logo/label (8*8 cm), in case of logo/label mark;
- Pending registration proof (if the trademark is filing with the priority claim within 6 months).

8. Validity of License and Renewal
A registered trademark remains valid for 7 years from the date of registration. However, trademark can be renewed for any number of times for a period of 7 year at a time.
A trademark can be renewed within 35 days after expiry, plus a 6-month grace period with an extra fee.
Note: If a trademark registered at the DOI is not brought into use within 1 year from the date of registration, the concerned department shall conduct necessary inquiries and cancel such registration.
